Pro-Palestinian NGOs sue Trump administration over ICC sanctions

Two pro-Palestinian NGOs, Democracy for the Arab World Now (DAWN) and the Taxpayer Alliance Against Genocide (TAAG), have filed a First Amendment lawsuit against the Trump administration in a Manhattan federal court. The lawsuit challenges Executive Order 14203, issued in February 2025, which imposes sanctions on the International Criminal Court (ICC) and individuals assisting its investigations into US personnel and allies like Israel. The NGOs argue that the order violates Americans' constitutional right to engage in human rights advocacy related to Palestine and to associate with sanctioned human rights defenders. The executive order specifically cites the ICC's arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant as examples of the court's "illegitimate and baseless actions." Mark Goldfeder, CEO of the National Jewish Advocacy Center, criticized the lawsuit, arguing that the plaintiffs lack standing as they have not suffered a direct injury, but rather engaged in self-censorship due to fear of sanctions. He also called the lawsuit "a confession with a case number," as the plaintiffs admit to activities the EO prohibits.
