The new orders also aim to deny birthright citizenship to children born to some foreign diplomatic staff and potentially in US territories. While no US law explicitly bans birth tourism, a 2020 federal regulation prohibits using temporary visas primarily for obtaining US citizenship for a newborn, with potential prosecution for fraud. The Center for Immigration Studies estimated that 20,000-25,000 mothers engaged in birth tourism between 2016-2017.
