Germany may make it illegal to deny Israel's right to exist

Germany's Bundesrat, the upper house of parliament, is pushing for a new law to criminalize the public denial of Israel's right to exist or calls for its destruction. The bill, proposed by the state of Hesse, aims to address a sharp rise in antisemitic acts in Germany since October 7, 2023, which Hesse's Justice Minister Christian Heinz stated has "spilled over" into public spaces. The proposed legislation would impose criminal penalties if such conduct encourages antisemitic violence or discrimination, with proponents arguing existing laws are insufficient and citing Germany's historical responsibility.

"We are introducing this bill now deliberately because the time has come to move beyond discussion and take legislative action."

Critics, including legal scholars and former European Parliament member Daniel Cohn-Bendit, argue the bill may infringe on freedom of expression, as it specifically targets the denial of Israel's right to exist while other states are not similarly protected. The debate centers on the tension between freedom of expression and combating antisemitism, with the Federal Constitutional Court potentially having the final say on the bill's constitutionality.
